I was familiar with the Posse Comitatus Act, but on a whim I found an applicable exemption listed on Wikipedia in 18 USC § 831 - which says that the Attorney General may request that the Secretary of Defense provide emergency assistance if domestic law enforcement is inadequate to address certain types of threats [...] such as potential use of a nuclear or radiological weapon. Such assistance may be by ANY [emphasis mine] personnel under the authority of the Department of Defense. Of course, since such weapons have only just been (re)discovered in this world, no such exemption could have been written yet. If it did, and provided the AG was on board, the General would simply argue that since Orca provided them the original weapon he may have access to, and be plotting to use, another.

The more believable alternative is that the General expected the next POTUS to grant blanket pardons to himself and elites in the event their illegal actions were discovered.
