TOSBY COMMISSIONING ME YOU AGREE TO THE FOLLOWING TERMS OF SERVICE AGREEMENT.
General Terms:
。Client must write in a clear and kind manner. Any ill behavior will NOT be tolerated and will result in a cancelled commission.
。Client must provide clear and neat references (if none available, a detailed description will do).
。Client must be 18+ to commission NSFW art from me.
。Client must respect the given wait time; I occasionally have some other priorities, and sometimes I may be late on commissions.
。If you need your order by a certain date, please ask me BEFORE commissioning.
。If you fail to follow any rules attached to commission types, including these Terms of Service, I have the right to decline your commission.
Payment:
。Payment is made via Paypal or DeviantArt.
。Payment must be sent in USD or DeviantArt Points ($1=100 DeviantArt Points).
。Payment will be paid via invoice or the Commission Widget on DeviantArt.
。If done over PayPal, Payment will be paid as "Goods and Services."
。Your Address will NOT be included unless receiving a PHYSICAL commission (print, sculpture, etc.).
。Payment must be sent before I start the artwork (unless previously negotiated with me).
。Payment must be made within 24 hours of the invoice or I will scrap the commission (unless previously negotiated with me).
Art Progress:
。Please give up to a month for art to be completed. Due to personal circumstances, I may nott always have a lot of time.
。I will talk with you and work outlines and edits if you wish; at this time you can ask for changes. Then I will work on colors/shading in my own time (you may ask for minor changes now).
。I will only send "Work In Progress"s if asked, as I generally try and finish a commission in one sitting.
Refund Policy:
。I do not typically offer refunds; however, there can be exceptions.
。Refunds will be given as soon as the money is available (Take note: I do pay rent and bills, so sometimes, I do not have the money in my account).
。Refunds will not be made if the full image has been completed.
。You will receive the initial payment exuding the Paypal tax. You get back what I received.
Ownership Rights:
。Artist takes credit for the artwork, Artwork belongs to you.
。Client has the right to use the artwork however they would like.
。Client cannot sell just the artwork for monetary gain (on shirts/posters) without permission.
。Client must seek approval from the artist before reselling the artwork. (Must not be sold for more than paid for).
。Client MUST credit the artist if asked about it or when posting it online.
Blacklist Policy:
。Charging back a payment.
。Commissioning NSFW while you are under the legal age.
。Being a rude and unprofessional individual when dealing with a matter.
。Being openly homophobic, transphobic, racist, pedophilic, xenophobic, antisemitic, sexist, ableist, or otherwise bigoted.
The above stated will result in a blacklist from me against you; therefore, you will not be allowed to purchase art from me.

Anything Including Hate Speech of Any Kind (homophobia, transphobia, sexism, racism, ableism, etc.)
If I am not comfortable with the request, I can say so and refuse the commission.
I have the right to refuse any commission or cancel a commission any time. |
