Wings could be better they were done in a rush to have the suit ready for Calgary Comic Expo, I hope to upgrade them in the future. Its a great suit to run around in as kids really relate with the character.

I don't think so. Money/profit doesn't factor into the legality, it only factors into the financial damages charged on top of punitive damages. They just don't usually pursue/defend the trademark unless there's an image issue, or market infringement, or both.
Like, if you wanted to make Mickey Mouse t-shirts, and give them away for free, Disney might take issue because Disney makes and sells such things, and you'd be infringing on their market, in addition to using their licensed property without permission.
