That's alarming on several levels. First, I want to thank you for taking the time to let me know of such a thing. I appreciate the consideration.
Now on to why I'm alarmed:
1- I'm afraid I don't have any record of the original owner giving away the rights. So by my records, the ownership still reside with
There is a specific process I request from those who choose to give or trade: details on my FAQ, under "character trade". Which has not been satisfied in this case.
2- I have no idea who komodoro is. So this would mean you're the third owner, when I never knew of the second.
3- The most important alarm: Was money exchanged for it?
---If the original sold it to the komodoro individual, then they've broke their contract with me. As they don't own the profit rights (so resale is forbidden).
---If the original owner simply traded or gave it to komodoro, that's fine. I believe this characo is before I had my trade policy, but it would have still been prefered if I was informed of the trade.
---If komodoro SOLD it to you, (especially if they didn't really get it from the original owner), then that's several violations, which includes theft from me AND the original owner. You should file a complaint and get your money back by any means.
4- If money wasn't exchanged, and it was just a trade from original owner to komodoro and then to you, then for me to acknowledge the rights transfer, I would need you to contact the original owner yourself and inform them of the trade, and request they submit their part of my "character trade" requirement mentioned in my FAQ.

I will inform the original owner of the situation, and your possible contact, but you must reach out and fulfill the requirement. In the meantime, please do not use the design, evolve a new design from it, make up a story, etc..

hi! no problem, I will contact midnightwolfsune and ask. :) no money was exchanged as I only traded a character of mine for this one, I received the hi-res (just over 4mb) file as well, and I guess that's not something anyone would have if they didn't have the rights to the character...?

Concerning the question: That's part of it. The rest is business ethics, honor, security, and etc.. Since I maintain commercial rights, And the original client paid for the service, It's more proper we each have a record of the first ownership transfer. Though in my case, I must keep track of all future transfers as well. So yeah, just having the hi-res isn't enough: There are numerous scenarios you could have gotten the hi-res behind the persons back.
Though highly unlikely, I have to take all of that into account. Partly out of respect of the current owner. I find it my responsibility to ensure the rights they paid for are not being violated. I does seem like a lot for just a fun activity, but this is my business (and my shared asset) at the end of the day. And I must regard it as such, no matter how insignificant some instances may be :)

It's only been...a little less than a day? One should give another at least a full 7 days before checking in. I'm certainly in no rush, as far as I'm concerned, my part is done until whichever time I may received the transfer emails. I've conveyed my position, and the info, so it's up to you guys :) I only ask you please don't bug the original owner about it.

No. I'm sorry, it doesn't look like you read my replies, or I wasn't clear: please go to my FAQ, where the instructions on "character trade" is provided. Also, in case there is some confusion, you're not helping me track down the owner. I'm only requesting you follow the "character trade" section of my FAQ if you wish for me to see you as the new owner. With the original owners help. That is the only way you may take it upon yourself to "solve" the case. I already trusted no money was exchanged, that's not the main point in why i have this system in place.
Though thank you for providing evidence in that regard, although it was unnecessary since I never recognized Komodoro as the owner. My mention of that was largely for your own sake.

Thank you so, so much for letting me know. Upon your message, I looked through their page and their other links.
I'm on the fence on what would be the most appropriate and honorable action. Passing the design along doesn't seem proper to me, when I still believe it's theirs. Despite my trade policy not being met with the person you got the design from, your honesty and time concerning this has not gone unnoticed. I do have a third option in mind, but offering it alone would be inappropriate and unfair in some ways.
So, I'm thinking of two options to balance out:
1- I can put you as the new owner if you wish.
--Because you took the time to come forward in the first place, your evidence, and because I do recall some type of discussion concerning this character and the original owner (ages ago) but I cannot find any record of it. It still irks me to not have the definite confirmation, but that vague memory of the mentioned discussion is keeping me from feeling 100% that I'm dishonoring their memory with this pass. (it's about...50 or 60 %)
2- ONLY if interested: I can give a promo code ($15 off) for if you want a characo design. I want to offer it for completely no charge, but I don't believe that would be fair on my end. You'll be only the second person I offer a characo promo to, so it feels fair to me.
So, either I can put you as the new owner, or you can take the promo code for your own characo.

I would love to commission you for a characo design, but most of all I'd like to adopt/keep this character as I've grown very fond of and attached to her. I would ask that you keep midnightwolfsune's name in the description as well, as the original owner of the design, and simply add me as the 2nd or 3rd owner, whichever is most appropriate in your opinion.
I will definitely come to you for a characo design later, and I know this voids the promo code offer, but that's alright with me, your work is more than worth paying the full amount, when the time comes!
