PLEASE READ THE *FULL* DESCRIPTION:
This is my way of saying FUCK YOU to dA.
I got banned from deviantART over this image, and this is how the story goes…
deviantART removed this image in late '04, a few months after I uploaded it and set it as my first deviantID. Their stated reason was 'copyright infringement'. I filed a complaint with their helpdesk, because it was in fact a pure Photoshop work, and 100% of my own making. The dA administration blew it off, and after the initial "we're forwarding it to the people who take care of submission violation inquiries" reply (why the fuck do they need to forward it? what's the point of giving me a 'submission violation inquiry' category to submit it to in the first place if they're just going to have a middleman read and forward it anyway??) I heard nothing back from dA. A year passed.
I eventually notified the dA staff via helpdesk that I was dissatisfied with their failure to rectify its removal, and would be re-submitting it if they didn't make an attempt to explain their reasons for removing it. Another month passed without a real reply. I resubmitted it, and was immediately banned from dA..
now, it's fairly obvious that this submission was not in violation of their policy, and I could go on listing inexorable reasons, but they become redundant after a while…
1) It's my own original work, therefore the copyright is my own, and other people's copyrights do not apply.
2) Even if it wasn't, South Park is Creative Commons, meaning that people are free to do a number of things including making derivative works.
3) Trademark could be an issue, but that's not copyright, and dA explicitly stated on numerous occasions that they will not enforce trademark, and used that as an excuse to not do anything about character theft.
4) It's my own character, so trademark doesn't apply either in the case of South Park (you can't trademark a primitive style) and there are a MILLION or more pieces of un-removed Matrix fan art on dA (many with DDs) that bear testament to dA's blatant disregard for the Wachowski Brothers' intellectual property.
You can probably see the pattern by now, and start filling in 5, 6, and up on your own…
Some of you are probably thinking now that I left dA over that… You'd be wrong. This incident certainly contributed, but it's not for this or any other retarded decisions made by dA staff; it's for the lasting impact of the perseverance of those who make them in their administration... and the gaping, long-unpatched holes in their Swiss-cheese like policy that allow things like this to happen, yet refuse to stop or punish REAL art thieves.
There are many other reasons too that go far beyond simple policy structure and enforcement, and you can read all of them here, in my Open Letter to the dA Community:

Well, I left DA originally from what they said about their policies in their damned artist agreement contract.
Two reasons from that contract that I left is that one, they will redistribute any art on posted on DA along with the artist's name to promote and make money for DA, but will not go as far as even making an attempt of giving the artist royalities. And two, they allow any art posted on DA to be copied, altered, and reposted by someone else and they will not do anything about it.
Because of that I took all my art off DA and moved here to FA when the original FA was still up.

Deviantart has become exceedingly gay these days I had a troll multiple or just one can't remember but I got banned for sticking up for my own page??? Bullshit I know right?Well anyway Da emails me trying to sell me shit and I'm like You'll never see another dime you damn Nig****.Anyway mad Kudos for this one and a fave and yes a few of my friends from my old account that I'm still banned from have also been banned. Da yer just so stupid and so fucking gay!!! So Fuck you DA not to also mention they said I threatened someone and can't even provide a a valid link to it and have no proof.Their just a bunch of haterz.Fuck em!!!Watches you I like this pic.
15 years later and they're going full-crazy with the unwarranted bans now. Thousands of people are recently coming forward about how they got banned for no reason and it's just getting worse. Eventually they're not going to have any users left to ban and they'll just have to shut down the site (I hope.)
To this day I still don't have my account back and I'm not allowed on the site. I said in my appeal that I would change my behavior and I've learned from my past mistakes and they did DOT reply AT ALL. No joke, not a single comment was given on my appeal.
The last person to respond to my appeals was RealitySquared. Are you guys seeing a pattern here?
(Ironically even though my case has nothing to do with wrongful accusation of art theft, RealitySquared is an art thief himself and even allegedly got arrested for it once.) He informed me that my ban is permanent not even half a day after another administrator made it clear that I could come back in the future. They then decided to agree with him.
Fuck you, DeviantArt.
