Legally they're not supposed to, in fact that was the true reason behind the whole "hot coffee spill" lawsuit. But it's done because they expect the person ordering the coffee to not be able to immediately drink it due to being in a car. Nicer, locally-owned coffee shops, for example Creedo Downtown in Orlando, don't do this, because they primarily expect local clientele rather than commuters on the go.
