I suspect we now know why the Inspector insisted on having Fifine present for this re-enactment. He probably had the same thought, but it wouldn't come out as an official accusation if Fifine said it. Now the Baronet has a chance to dig himself in deeper by inventing an excuse that the Inspector can officially refute, building a stronger case against him at the same time.
Yes, I feel the inspector spotted that Fifine was a bright, inquisitive girl, (which is a positive SCANDAL in the Victorian era, a place for everyone and everyone in their place, that sort of thing) and he is encouraging her inquisitiveness to get the 'elephants in the room' noticed without him having to make 'estimated guesses' (which do NOT hold up in court when the investigator makes them). The fact that he's empowering the young vixen is a happy (for Fifine) side effect. Her Mom is still of the 'kids should be seen and not heard' mentality, never liked parents who used that style, teaches the kids to not share ideas, which is effectively the same as teaching them not to HAVE ideas.

However, considering her age, mixing up tenses seems entirely appropriate for her to do. So I'd be inclined to leave it.
