Technically the no refund if I'm correctly legally only counts when you leave with said product. As the service is the product him not leaving voids the no refund part especially if not told as then that falls in line with theft by scamming something very serious by law.

I don't think that's true in the case of a gym. They get you to sign a contract that locks you in. Didn't bother showing that but it's a thing.
