No I believe you o.o But if (for instance) a police officer has such a warrant to go rifling through your car and finds your hookah, they can almost definitely confiscate it on the grounds that it is "drug paraphernalia," whether it has been used for it or not. It is possible to read the AUP in the same way; if it can be used for drugs, and you can't tell just from the photo that its not being used for drugs, then its just as bad. Welcome to America.
I don't wanna make it feel like I'm white knighting ^^ I just hate to see people get in trouble for silly little things like this. I may not believe that there is anything inherently wrong with the picture, and I'm inclined to believe you when you say its not being used for drugs - though simply on the virtue of, "Innocent until proven guilty." But this site is free to use as long as the rules are followed, and the rules are there to protect the liability of the people that own it and blah blah blah -- can't hurt to just do what they say so we can keep this free service available.
