I think the reasoning is that he's done. She won the fight. Killing him now would be only revenge and cold blood. Just to make herself feel better. Which is the same/similar logic to his abuse. Not to say I don't think it's not justified. But it travels down a path that can't be backtracked and it's also pretty much what the sick jerk wants at this point. Calling her weak etc. If she doesn't kill him. He keeps living/taunting her. If she does. He wins because he drove her to be so full of rage she outright murders him. It's unfortunately no longer self defense at this point.
Realistically? Nope. If she had done it when he was still standing and holding the axe, then yes, but he's on the ground now. For all intents and purposes, in the eyes of the law he's been neutralized as a 'threat' and it's no longer self-defense so long as he stays down until the police arrive. Now if he stands back up and takes another swing, that'd automatically be considered attempted murder on his part and she could absolutely kill him and face at most a few years in jail for murder in self-defense.
There is a possibility she could get her sentence mitigated if she did kill him, but she wouldn't get off. Justifiable Homicide, which is knowingly killing somebody because you have a cause to believe beyond reasonable doubt that they will attempt to cause great bodily harm to you or someone else in the future even if they have been 'defeated' at that point of time, would apply here since he actively interrupted her attempts to call the police for help. Stella would still go to prison, however, even if she could prove 110% that he was absolutely planning to try and kill Eve or her again in the near future. I don't think this would qualify as a felony charge of homicide, but unless I'm mistaken Justifiable in the US carries a minimum 5 to 10 year prison sentence, so she'd be looking at around 7 years in prison for killing her father, even if it was to protect Eve and herself.
I may not have all my facts 100% in a row here, I'm not a lawyer and I never studied law beyond making sure I know how to defend myself and stay on the outside of a courtroom. I may have some things pretty wrong, but either way Stella will go to jail if she kills her father. The only way that she wouldn't is if she was forced to in the presence of the police and they were able to verify that she had no choice.

When trying to stop a monster, make sure you yourself, don't become that same monster... You have to stop the wheel. Be a better person. My foster parents were absolute monsters -- but they got theirs. I didn't go down to their level. And she's right- doing something like that -- it sticks to your soul, it doesn't leave your mind. Like Mark Twain said, 'I've never killed a man, but I have smiled at a few obituaries'

I've never been in this position, but I have before stared down the path that could have taken me to this, and even doing only that chilled me to a bloodcurdling fear. This comic is so good because jeez--it brings memories of simply looking at the edge, and how only looking can be such a it-got-real moment. Stella could go either way, she really could. The tension is that much higher because there is no safety left, there is no nothing to stop her. Only by Providence, is Evie there, just the person to happen to Stella's life to maybe keep her from going over the precipice. And that reaches me at least, I love and fear that interpretation of mine at least. It's gripping.
Literally all day I can think about is Evie. My heart... This is such a beautiful comic, and Evie is just a sweet sweet little angle. ;O;
Them growing up healthy and strong is all I want for Stella and Evie. There are so many times I come close to cry, but...
But what really brought tears to my eyes was your artistic goal, Vika, "drawing would remain as your main occupation no matter happens in life." Only someone as beautiful as you are can convey such strong emotions in a comic. I hope you all the best, Viktria.

Reading this now I really like this page. While it might seem like it uses the "If I kill you I'll be just like you" trope, it really doesn't in the context of the scene and the setting. Evie isn't trying to convince Stella that killing her father would make her a bad person. She's trying to save Stella from her impulses so she won't lose her.
Honestly that's what makes this scene beautiful not just from an art prospective but a writing prospective as well.
