They are looking at it as an adult got in to a fight with a minor, ignoring that the minor is now claiming he started it. It would be in the judges power to override the jury's verdict if he felt the circumstances allowed for mercy. However i sadly dont see that happening and someones life now being ruined.
The defense can appeal the decision and go for a retrial, but it will still stand that the fight was against 2 minors and Derek joined in of his own free will.
Life sucks.

False, the prosecutor brings the charges in criminal cases. Even if the victim drops the charges, that doesn't stop the case. See here:
