But, but. Mushrooms are not vegetables, they are fungus.
Vegetables are any part from a plant which is not the fruit.
Fungus are not plants, thus mushrooms are not vegetables. Heck they have a seperate Kingdom in the tree of life.
Heck, if you wanted to consider fungus to be in a similar category as plants, with regards to fruit/vegetable. A mushroom top, like what we eat (and she has on her head), would probably be closer to a fruit than a vegetable, as it is the fruiting body of the fungus which dwells below.

Tomatoes are fruit, yes, botanically.
However, during a trade and import tax dispute when a ship full of tomatoes tried to avoid the United States vegetable tax by stating that the cargo was indeed fruit (and thus, should not have to pay the tax), the judge ruled in favour of the state (with little surprise), stating that "As they are not consumed for dessert, tomatoes are categorized as vegetables."
