But you do realize that Nintendo is in the right and that their art isn't protected under Fair Use. Unlike Viacom, people are actually using copyrighted characters unlawfully. This is why projects like AMR2 and Pokemon Uranium got taken down, they used assets of copyrighted content that wasn't theirs. Sure it's unfair, but that's life. While on the other hand, Viacom while taking down full dumps of episodes from shows, they also took down material that was under Fair Use that were criticizing the series AND barley used any copyrighted content. So next time Nintendo or anyone else takes down art, just go with the flow and accept the take down.

Here's my problem with that argument simply because Nintendo is in the right to it doesn't mean it's smart for them to do it, it can be seen as Nintendo suddenly hating money and taking down creators for giving them free advertising which is certainly the case in the case AM2R and Pokemon Uranium "oh we know you were just trying to make a game so people could experience Metroid 2 goodness without having to dig out their old as fuck gameboys and play it on the most limited hardware we've ever made, but we're gonna need you knock that shit off..... yes we understand this was free advertising for us..... no we're not fucking idiots"

And you do realize that Nintendo does have Virtual Console releases, and maybe the possibility of them wanting to protect their IPs. Taking away free advertisement, yes. But are they breaking any laws, no. Nintendo has the full rights to take down whatever they please that doesn't fall under Fair Use. I'm not saying that this isn't archaic, but laws like the US has for Copyright has to be changed drastically, not over night. Let's put this into more of a perspective of furries. For example, if you created an OC and someone used that OC in their works that you didn't like what would you do? If you said take them down, then it's hypocritical since Nintendo is doing the same exact thing. If you said yes, then I think that you're one of those "Everything on the internet should be free" types of people. And yes, while you do have the right to let the person do whatever with the OC, Nintendo also has the right to take down content as well.

I once had a Chao in Sonic Adventure 2 that I raised for 2 years... I lost the memory card with my SA2 file and thus my Chao. I was deeply heart broken.

I fear the DMCA system exploit on tumblr aswell. other than the the defenders of course. It's really hard to know much about Ninty doing this since I haven't seen much news articles about this lately.
