This is a commission for Bergham, a few years ago he won an commission auction, and somehow both of us forgot about the thing, we picked up the thing and rolled with this one! Probably because they don't want to incite the wrath of Hasbro again.
Hasbro would be hard pressed to win a case against a game with original characters that vaguely resemble the personalities of their intellectual property; but I doubt the developers have the money to fight them off. So they probably want to keep a low profile until they've made some money.

True, they don't have a case; but large companies will sometime sue even when they know they'll lose so that they can either delay a product's launch or so they can make a small firm amass legal costs that they can't afford to pay and thus sink the entire project.
If the game becomes profitable then the creators can afford to advertise it and if necessary defend the IP against Hasbro. Right now though its wise for them to stay under Hasbro's radar as much as possible.

Oh, I'd LOVE to hear what Hasbro has to say about this project now! "Hey, stop making this game! It's a copyright law infringement, 'cause it has our characters... well, it doesn't really have our characters in it, but your characters resemble them... well, probably because your lead artist and character designer is Lauren Faust who worked for us before, so I guess she didn't change her art style much since then. But we all know you've stolen this idea from us! Not the idea to make a fighting game, since MLP is about friendship, not about fighting, but the idea of four legged animals who can speak and act like humans! We came up with that first! Except The Lion King and 101 Dalmatians that also feature four legged animals with human behaviour. Well... Stop making this game anyway, because... Because we said so!!!"
Aha! They were making Fighting is Magic as a non commercial MLP fan project and Hasbro closed it. Now they have risen again and gonna make their game no matter what, but Hasbro's characters are no longer a part of it. Hasbro could have a great MLP game that would be a free advertisement to them. Now I hope this game will be a great commercial success and Hasbro will lose a lot of money because of it! Hasbro doesn't deserve to have their characters in such great fan projects anyway!
