Dreizehn saw a pic, my snapshot (only this link, https://farm6.staticflickr.com/5506.....4c8171f_o.jpg) of ranny, he didn't know who is that , but he likes that , so he drew one for himself, yes, a FAN-MADE mod (re-creation), then he gave to his friends , they all know what happened and use it , when people ask him about the mod, he will answer/credit the link of my snapshot (he didn't know Google can search image with just put the link of the image and press search button)
Until i saw Zaisen (the red one, Dreizehn's friend), some messy happened and it makes the things more messy , so '-')

Still kinda questionable that he would see what is clearly a SL mod someone else made, and then just go copy the design instead of seeking out its creator. Just because it looked neat doesn't make it okay for you to just go take someone else's ideas.

No, I don't think it is harsh. They saw something that was clearly made by someone else, and copied it without even seeking out the original creator. It doesn't matter if they were trying to sell it ( though they DID begin to pass it out to friends for free, and who is to know how far that would have gone before Rei found this on their own? ) - people in this community should know by now that the characters we all create are really personal to the people who created them, and it is just rude and inconsiderate to flat out copy the ideas of someone else and use it as your own. The design they made was so close in concept to the original, that unless you look very closely, you would think it was exactly the same - that is more copying and 'being inspired by' if you ask me. The "personal flair" was hardly different. Had they been more different, more distinguishable, then maybe I might feel differently. But as far as these two mods go, they're nearly exact to the point where the second one comes across as a "Cheap knockoff".
If I tailor made all of my clothes for school, put all of my personal touches and preferences and ideas into the clothes I made, and then came to school and someone else had copied all of the care and effort I put into my own clothes, yes, I would be upset. Would you not be? If you put in so much effort to make an outfit 100% your own, and put in all the work yourself, and then someone just lifted your ideas like it was no big deal? This isn't a matter of someone just going out and buying the same colors, or buying the same shirt and wearing it ( or buying the same mod, which would be no problem ) this is a matter of just seeing someone else's idea, and taking it without any regard for not only the personal feeling of the original maker, but no regard for the concept of Intellectual Property as well.
A lot of people like to toss around the idea that imitation is the greatest form of flattery.. And in some cases, and to some individuals, it can be. But in other cases, I almost always consider it rude and inconsiderate, and I am ALWAYS far more impressed by people who come up with their OWN ideas, rather than piggyback on the creativity of others. In this case in particular, while it is nice they made their own textures, but for how similar the two mods are, I would hardly call the copied one "creative if a bit imitative". The technical aspect of creating the copy is there, and its nice that they didn't just illegally rip the textures, but the amount of "creativity" that goes into copying something that already exists is.. well, none.

You keep making the analogy to people copying clothing or your look in second life, and those two things are totally different than the situation that is present when someone copies someone else's IP. When you make a look in SL, even if you are buying it all from stores no one has ever heard of or from something brand new that not a lot of people have - when you put together that look, yes it could be considered rude for people to copy your exact look. But just like in real life, those things are MEANT to be mass produced and 'copied' by a lot of people, that is why they are for sale. No matter how obscure you try to make your purchases, the fact remains that they are meant to be replicated over and over - so while it is indeed annoying when people copy you in this way, it is acceptable because that just how those things in particular work. They are intended to be owned by as many people as possible, they are intended to create trends, they are intended to be imitated.
This is not the case when you are dealing with an artist's Intellectual Property. Unless the artist has gone and made their work available in ways which would allow multiple people to obtain/use/share their work, then it is most certainly NOT intended to be copied or used by other people. I can't tell from your profile here if you are an artist or not, since you have nothing posted on it - so maybe you are not a person who creates original IP and it is harder for you to grasp the boundaries people are crossing when they copy the IP of someone else? I can't be sure. It is just not the same situation as someone dressing the same way as you or wearing the same hair style. Those things can be annoying, but it isn't quite the same as the situation here. Simply wearing a pony tail is not the same thing as pouring your creative heart and efforts into an original piece of artwork.
Legal implications such as IP and copyright completely aside, art is an extremely personal thing to most if not all artists. Many of us have learned to deal and accept that fact that some people out there might try to copy us, but I would bet money that most artists out there do not LIKE the fact that it happens. And that alone pushes many artists to ditch the online art sharing community as a whole. Because too many people don't seem to understand boundaries and respect when it comes to work other people have created. They copy it, they steal it, they use it without permission or credit, and it leaves a foul taste for a lot of artists who have experienced it in some way. Artists own the work they create, and they work hard to create it, and they have every right to defend their work and ideas if they feel like someone is trespassing on their efforts. Too many people don't seem to grasp that concept, if you ask me.
I don't really know any of the things you feel passionately about, so I can't really try to come up with an analogy that might make sense for you personally. Imagine if you were in school, and you had an assignment to write a short story based in a fantasy world. You put all your time, effort, and imagination into creating a luxurious fantasy world with fantastic characters and unique landscapes, and you are just really proud of what you have written. Now imagine you showed it to someone, and when it comes time to turn your papers in you find out that the person you showed it to copied your story - but maybe they changed the name of a couple characters or the name of a village or mountain, and instead of a giant purple mythical creature they've put in a giant blue one with some horns, and the plot is mostly the same except the main character has to defeat an evil sorcerer instead of an evil witch. Would you not feel offended that for all the thought and effort you put into this, that someone you showed it to just copied all of your work? Do you think the teacher would not notice the similarities, and deem this as unacceptable? Likely, both you and the student with the copied work would be asked to meet with the teacher to discuss why the two stories are so similar. It is not okay to copy the works of others in an environment where it is expected for you to flex your own creativity, and that is the type of environment you are in when you are creating artwork, literature, SL custom texture mods or whole avatars, and other similar works of art.

And, just to add in using some response to the other comment you mentioned, it is okay to imitate the works of others privately for practice. Copying the Mona Lisa is a great way to practice painting skills and explore artwork styles from that period. However, this is a completely different scenario when you are imitating your peers. When you copy your peers in an artistic environment without giving credit where credit is due, you are hurting your peer's chances to gain the recognition for their work that they deserve. Asking permission is a courtesy, and most people expect it before someone attempts to copy their work. Plenty of artists on these online communities will copy the works of others in order to explore new ideas, but generally do not SHARE those copied works until they have used what they learned by copying in order to create something more original and different than the original. Leonardo DaVinci is long dead, and his work is well known and recognized, to copy any of his works is obvious, but it is still proper to credit a derivative work from his art. Most artists on these online communities simply cannot be compared to DaVinci - they are still working to make a name for themselves, they are still working to make their mark, find their individuality that will make them memorable. In a modern world and in our online communities, it is much harder to obtain recognition, and when other people attempt to make "derivative" work of something you have created without giving you proper credit for it, your efforts are hurt. People who share their artwork online or make it available for others in any way for the most part care about recognition for their work, or they would not be sharing it.
So in the case with Reituki as an example.. If the person saw this mod and liked it, and decided to try making it on their own for personal and private use - fine. But that isn't what they did. They copied it, they wore it around in a fashion where it was not possible to credit the original artist, they did not ask Reituki for permission before making their copy, and they distributed it to their friends.

I think we will simply have to agree to disagree on our thoughts on the issue, but it was a good discussion none the less. I read your whole post, but I don't feel there is anything more I can contribute to the conversation without being repetitive, and I think we have both clarified our viewpoints pretty well. :)
