Yep, it is! Through some rewording of law, and reformulation (a slightly different species of wormwood, I think). The stuff we had was tasty and made my head swim, but it wasn't exactly a victorian dreamscape... but I also didn't have very much. I suspect the original stuff is stronger, too.
In Canada, there are different regulations from province to province as to the amount of thujone that is allowed to be present in absinthe. British Columbia is the only province with no regulations (those crazy west coast pot-heads! *laughs*).
If Wikipedia is to be believed, now the US laws are on par with Ontario. That's pretty cool. :D
