First of all, please consider that English isn't my mother language, so there might subsist some mistakes. Please, if you see some, don't hesitate to note me about it !
I'm fully aware that some of you won't read my TOS before purchasing anything from me. As long are you are conscious that they apply even if you didn't read them, it's perfectly fine.
If you do not agree to them, I suggest you find another artist to commission, DA is the perfect place for you to search.
These TOS were edited on November 27th, 2020. They don't apply to any artwork I displayed before. On old deviations, only specific rules I gave on descriptions apply.


GENERAL
Please, refrain from taking my art as reference. I don't want any of my drawings to be traced, or any of my designs to be duplicated.
You will always receive a full-size file. If I don't specify anything on my posts or during your order, you will be given files from 1500x1500px to 2000x2000px.
If you ordered something with a background, or if I add one for sharing the drawing, you will have access to the transparent and the background file.
Please keep in mind I clean my gallery every once in a while, and I could delete the artworks you purchased. So, please, be sure to download everything I furnish to you.
By commissioning me, you agree to every of the TOS listed in this journal and the additional rules that can be added on any artworks description or the ones I will note you when taking your order.


ABOUT MY ART
As I'm always trying to improve my art, my style can slightly differ from one drawing to another. Please don't be offended if the piece I give you isn't strictly similar to my examples.
For complex drawings / characters, I may ask more than my usual prices.
As I'm not comfortable with human stuff, I will only draw animals.
I will also refuse any NSFW commission, as I don't have any practice with this universe.
Please excuse any anatomical and lightning mistakes, I use references but I do not trace.
If my artwork doesn't fit to your character ref, I can change what needs to be modified.
If you want to see WIPs, please specify it when ordering. If you don't specify, I will go for the entire piece and show it to you only once finished.
If you don't like the WIP sketch and like me to start over, I'm free to use this sketch for another commission.


COPYRIGHT
Under no circumstances you can claim my work as your own.
You must always give credit when you share one of my artworks. All my usernames on several platforms (Instagram, Furaffinity, etc) are linked under these TOS. If I don't have an account on the platform where you want to share my art, please link back to my DA.
You are allowed to share any of my artworks if you want to.
I remain the one and only owner of every artwork I create, and I can use them for any non-profit thing such as advertising myself. I will of course give you full credit for your characters if I get to draw them.
You're not allowed to trace any of my artworks, nor copy any of my designs.
I use a small signature on every of my artworks, please don't remove it.


COMMERCIAL USE
You are not allowed to use any of my artworks for commercial use. Exception made for designs, please read below the particular sections.
You can print the pieces you commissioned from me, as long as it stays for personal use only.
If I didn't talk to you about it before you paid the commission, I won't use any of the artworks I made for you for other commercial purposes.
If you want to sell one of your characters which have one or several artworks from me, please be sure to take into account the price you paid for these pieces in your final estimation.
For re-selling designs you bought from me, please read the particular case section below.


PAYMENT
I can accept PayPal, DA points and art as payment.
My PayPal account is set to accept €, USD, AUD and GBP. If you wish to pay with another currency, please let me know so we can avoid you to pay any fees.
If you need an invoice, please just ask !
I don't accept all means of payments on each artwork. Please don't be offended if I refuse your art proposal when I specified I was only looking for money offers.
You can choose to pay half of the price before the first sketch, and the other half after agreeing to it.
If the artworks I owe you takes longer than 2 months, I will refund you completely.
I can refund before the 2 months deadline only if I didn't start your commission. However, if you urgently need your money back for some reason, please don't hesitate to come and talk to me about it so we can figure out a solution that can arrange the both of us.
Please, even if you commissioned me before and already know my PayPal address, wait for my instructions before sending money. I usually post my artworks on others platforms, and people could have claim before you.
Please don't back up from auctions you won, unless you have very good reasons to do so. If you backed up without any good reason, I'll block you, and you won't be able to buy any art from me in the future.
Please don't ask any PayPal chargeback just to try having a "free" commission. I guess respect and trust are for everyone, including you and me.


PARTICULAR CASE : DESIGNS
Please, when you draw and share a drawing of a design you got from me, credit me as original designer in the description.
I've got a ToyHou.se account, please if you upload my designs on here, be sure to credit. My TH username can be found at the end of this post with all my other social medias links.
You can change whatever you want on my designs once bought, as long as you still credit me as original designer.
For headshots designs, you are allowed to add you as co-designer if you drew a fullbody ref for them.
You can't use any of my designs to make profit. This includes breeding; I don't want any of my designs to have childs made by you and sold.
Exception is made for Howrse, you can post drawings of my designs as long as you are the author of the drawing, and the owner of the design is ok with that. You still have to note me about that before sending it to the Black Pearl.
You can resell a design you bought from me, but not for more than it's original price + value of its additional art. If reselling, your personal art doesn't count in his value.


PARTICULAR CASE : REQUESTS
I do accept requests, but I'm being peaky on characters.
I do have the right to re-use some lines I did for a request, being for profit or not.
The art you ask me as a request should not be valuable if you sell the character this art was for.


Please keep in mind these rules are here to protect you as buyer, and me as seller. They are subject to change, but all further modifications will be dated, so you know to which rules the art you got from me apply.
