I'm writing this since i've seen plenty of artists who think that just because they can draw and/or take commissions they are entitled to do whatever the hell they want and act as immature as a little brat.

Based on my previous and current experiences i came up with the idea of my own "TOS". If i want to get a commission from you, then you should read this carefully. Otherwise kindly explain me that you won't take my commission based on this terms. Thanks

1- You're getting paid, IN FULL upfront, whenever i commission you, i won't ask for free art, nor ask for discounts.
2- I expect you to deliver some WIPs, you may take the time you need, but don't remain silent, so a couple of WIP untill the finished commission is ready is all i ask.
3- I expect you to deliver the commission within a reasonable amount of time.
4- Waiting lists will be respected, i expect you to give me an estimate time untill you start working on my commission. I also expect you to respect your own waiting list, you have an agreement with customers.
5- You are getting payed, you're not doing charity, you have customers.
6- If you're unable to complete a commission, then don't take it, money sounds tempting but again, be responsible.
7- If you're not going to finish or even work on my commission, just cancel it and refund, end of story. Family, health, financial, mental and other issues ARE NOT an excuse to not finish your work, think of it as it you were working on a big company, they don't care about excuses, they want your work done, so do i, but this doesn't mean i won't urderstand if you're going through hard times. But still, act like an adult, and be responsible.
8- I will always contact you and look for you to keep communication constant and fluent, so i can help you complete my commission, i will not harass you. But keep in mind the following points.
8.1- I will contact you repeatedly, if you don't show activity in your known media.
8.2- If you choose to dissapear i'll have to act as a response of your attitude.
8.3- I won't hesitate to chargeback (if we use PayPal).
8.4- I won't hesitate to write an Artist Beware about you and make it public (artists-beware.livejournal.com).
9- Just because someone is giving you money doesn't mean it's free, it means that they trust you to work on their ideas. It's kind of like your salary, so i'm afraid bullshit TOS don't work in your favour, i'm going to repeat myself, don't take money if you aren't going to earn it.
10- If you are going to take too long and finish my commission 5 minutes before deliver it then you rather refund me than sending me a half-assed picture. I reserve my right to act according to points 8.3 and 8.4.
11- Last but not least, i really hope we can work together so we can both benefit from it, i suppose we're both adults so let's act like it. Leave mediocrity to the mediocres.

That being said i'm looking forward to get a commission from you, and that you consider yourself a Serious and Responsible artist.

Escribo esto debido a que he visto demasiados artistas que piensan que porque saben dibujar o hacer comisiones tienen el derecho de hacer lo que se les venga en gana y ponerse a actuar como mocosos inmaduros.

En base a mis experiencias previas y actuales se me ocurrio la idea de tener mis propios "Terminos y Condiciones". Si voy a comisionarte, entonces debes leer esto cuidadosamente. De otra forma amablemente dime que no tomaras mi comision en base a estos terminos. Gracias.

1- Se te va a pagar POR COMPLETO, por adelantado, siempre que te comisione, no te voy a pedir arte gratis, ni tampoco descuentos.
2- Espero que me muestres algun progreso, puedes demorar lo que necesites, pero no te quedes callado, un par de progresos hasta que este lista la comision es todo lo que necesito.
3- Espero que me entregues la comision en un periodo razonable de tiempo.
4- Se van a respetar las listas de espera, espero que me des un estimado hasta que empieces a trabajar en mi comision. Tambien espero que respetes tu propia lista de espera, tienes un acuerdo con clientes.
5- Se te esta pagando, no estas haciendo caridad, tienes clientes.
6- Si no podras completar una comision, simplemente no la tomes, el dinero es tentador, pero se responsable.
7- Si no vas a terminar o trabajar siquiera en mi comision, cancelala y devuelve el dinero, fin del asunto. Problemas familiares, de salud, financieros, mentales, etc., NO SON una excusa para no terminar tu trabajo, piensa como si estuvieras en una empresa grande, a ellos no les interesan tus excusas, quieren ver tu trabajo terminado, yo tambien, esto no significa que no voy a entender cuando estas pasando momentos dificiles. Pero actua como adulto, se responsable.
8- Siempre te contactaré y te busare para mantener la comunicacion constante y fluida, asi puedo ayudarte a completar mi comision, no te voy a acosar. Pero considera lo siguiente.
8.1- Te contactaré repetidamente si no muestras actividad en ninguno de tus medios conocidos.
8.2- Si eliges desaparecer actuaré en respuesta a tu actitud.
8.3- No dudaré en poner una disputa en PayPal (chargeback).
8.4- No dudaré en escribir un Artist Beware sobre ti y hacerlo publico (artists-beware.livejournal.com).
9- Solo porque alguien te esta dando dinero no significa que sea gratis, significa que te estan confiando para que trabajes en sus ideas. Es como tu salario, asique me temo que los "Terminos de mierda" no sirven a tu favor, vuelvo a repetir, no tomes dinero si no te lo vas a ganar.
10- Si vas a demorarte demasiado para entregar mi comision y terminarla 5 minutos antes de entregarla, mejor dame un reembolso en vez de darme una imagen mediocre. Me reservo el derecho de actuar conforme a los puntos 8.3 y 8.4.
11- Por ultimo pero no menos importante, espero que podamos trabajar juntos y asi ambos beneficiarnos, supongo que estoy tratando con adultos asique mejor actuar como uno. Hay que dejar la mediocridad para los mediocres.

Con esto dicho, me interesa comisionarte y que te consideres un artista Serio y Responsable.
