RULES OF CONDUCT
General | Posted 14 years agoSince I have had the misfortune to witness some egregious examples of bad behaviour in other people's journals and galleries, I am setting forth the rules of conduct for my account. This applies to journals and gallery. Basically, the rules are, behave yourselves. I have no problem with civilized discussion and debate. I do have a serious problem with boorish, ill-mannered behaviour, especially when the offender then tries to cry about their First Amendment rights, or excuse it as a joke, or claim they're simply expressing their opinion or whatever. The First Amendment does not apply here, and anyone who thinks it does is invited to read the text of it. As this is my account, I am the sole arbiter of what is and is not offensive, and those who have offended me will be summarily blocked. No excuses, no appeals. Anyone who feels sufficiently strongly about the matter is invited to take it up with the FA staff.

Bullying - We ALL have a part to play

One thing I see that dismays me quite a bit is this perception in our society - by which I mean the western world, generally - that (a) stopping bullying is someone else's responsibility - teachers, schools, the government, other parents and (b) that it's a problem but it's not my problem because my child isn't a bully.

Bullying is everyone's problem. We all have a part to play in stopping it. That, by the way, includes the pack mentality often seen online whereby long-time habitues of a forum or website will swarm someone who is new and/or expresses an unpopular opinion. There is a fine line between expressing disagreement with someone's opinion or correcting them for a faux pas because of their being new, and the dogpiling that so often results when someone makes a mistake. Guess what - that's bullying, and it encourages a bullying mentality.
You can do your bit by refusing to be drawn into that mentality and joining in the scrum. You can help someone who is being dogpiled by PUBLICLY being supportive to them. Again, you don't have to agree with their position, but you can treat them as a person instead of prey.
You can do your bit by stepping in when you see bullying taking place. You can do your bit if you're in a position of authority by not abusing your position, and making it a personal thing to enforce no-bullying in the workplace. You can intervene when someone you know, someone you work with, someone you work for, someone who works for you is set upon, verbally or physically.
Don't just sit there and wring your hands and decry the awfulness of bullying. Step up and refuse to accept it when you see it happening, refuse to engage in it yourself. And if you are a victim of bullying, remember that bullies are cowards and scum, and their activities are an attempt to gain respect and power. Respect that they are people, but do not abandon your own self-respect in the process.

ESSAY - How To Critique Art
General | Posted 14 years agoThere have been a few things that I've seen here and there on the web that prompted me to write this. Before I get going, though, I want to make it clear that this is not prompted by any commentary or feedback I've received on my own artistic or writing endeavours.
The first thing that strikes me, since I'm as guilty as anyone else of doing it, is that most of the feedback artists and writers get is a squee. To use a somewhat exaggerated example, a comment of "OMG OMG OMG this is so fucking hot I love it I love it!", while definitely an enthusiastic endorsement of popularity, is not critical. The mirror of that, which I've also seen, are comments such as "Meh, don't like boobs" or "Gurls wif cawks suxx0rs". These are also not criticism but (at best) an expression that the commentator's personal taste does not jive with the artist's. Most artists I know of would more likely classify them as trolling. In either case, however, both the squeeing and the trolling are less than helpful for an artist's development. Curiously, the usual reaction I get when I point this out, particularly from the latter type of commenter, is "What, if we can't say anything nice we should just STFU?" Well, in a nutshell, yes. Because one of the key points about critique is that it's not an attack. It can and should be couched in polite language.
Good criticism concerns itself with the strong and weak points of the work. For visual art, this means the most basic elements such as inking being crisp and clean, perspective guidelines being removed and so on; for writing, such things as spelling, punctuation and syntax being correct. The next higher 'level' addresses elements like plot, characterization and narrative flow in writing; in visual work this would be composition and proportions of body parts and objects in the image. Above that would be such things as how well did the artist or author do in expressing themes? Every piece of art - even pornography - has these elements. It matters not a whit whether the critic likes the theme of the story or image; what matters is was it done well?
Next, good criticism is couched in terms that encourage the artist or author to continue working and developing their skills. Consider the following: "You have no sense of rhythm or pacing, everything seems to be happening all over the place, like the scene in the bedroom, I thought Jill was fucking Mike and then it was Christine fucking Jill while Mike watched, when did that happen?" The statement is harsh and judgmental and contains not one iota of positive reinforcement. By contrast, here is the same thing written in a positive manner. "The changes in pace and flow are interesting but can be distracting as well; for example, the scene where Jill and Mike are fucking. It was unclear to me just when Christine arrived and took over with Jill, leaving Mike to watch them." This identifies the problem - a lack of clarity - without denigrating the writer. The same principle applies to visual art.
Last, good criticism restricts itself to what should be there. As an example, statements such as "You could have made this so much better by colouring it" aren't useful, because not all art is meant to be coloured. Similarly, don't fault a 1000-word short for a lack of novel-like character development. It's not a novel.
The last thing I want to say about criticism is directed to artists, and that is this: A good critique may identify many faults with your work, particularly if you're new to making art. It's not an attack on you or your worth as a human being. Comments such as the no-likey-boobs example aren't critique and should be ignored, but if someone takes the time to sit down and critically examine your work, then provide you with feedback, do them the courtesy of reading what they have to say. If something is mentioned that was deliberate on your part, then by all means respond and say so, but don't take it as a condemnation of you.
Now... that said, if anyone has any feedback to offer me on this little essay, please do! I might well re-write it with your comments in mind

The US Air Force - or at least, senior officials in it - have committed a huge act of disrespect to fallen military by disposing of their cremated remains in a Virginia landfill. This wasn't a couple of privates screwing up, either; this went on for three or four years. Furthermore, some mid-to-senior level officials knew about it, because there were efforts made to block inquiries into the whereabouts of remains by their relatives.
I don't generally like to share RL, but I've previously mentioned this; I am, in RL, in the Royal Canadian Navy. Canada and America have been allies for a long time now, and our respective armies, navies and air forces work closely; we are, in many respects, brothers and sisters in arms. So when I read this article, I could not believe, at first, that something like this could happen to the remains of soldiers, sailors and airmen and women. I feel as though someone, somewhere, has flung dirt in the faces of everyone who has ever stood up to defend their nation, and it makes me sick to my stomach that, from what I read in the article, this wasn't brought to light until recently. I realize the investigation and such by the Washington Post was done before this date, but there is a horrible kind of symmetry when you realize the article date is December 7th, the 70th anniversary of the attack on Pearl Harbour and the deaths of thousands of US military personnel.
Please, if you are American and outraged by this, do contact your representatives and your senators and let them know. Your voices will carry much more weight than those of outraged non-Americans - though I would ask anyone who thinks this is a gross injustice to the memories of these fallen and their families to write as well. They deserve better than to have their remains treated as trash.

First, let me clarify that these requests do not, in the least, creep me out; no-one is cyber-stalking me on FA (at least, so I hope). However, I am scared because I've been asked, by people who are long-time members of FA and of the fur fandom community, for writing. As in, offers of writing in exchange for art.
It's bad enough when people ask me if they may use my character in a piece of art, or a story, or something because for some perverse, self-defeating-type reason, I have this flash where I want to say "Oh, you don't really want to use them; they're nowhere near as exciting/alluring/sexy/other adjectives as <long list of characters whom I consider vastly more interesting/seductive/hot than mine>." I know this is rubbish, but there it is; that's my usual first reaction. I am a newcomer to this site and to the fur fandom, and awfully conscious of it. I'm also chiefly interested in the pornographic aspects of it which seems to trigger some of my residual religious upbringing in the form of guilt about what I enjoy. So, in a nutshell, self-deprecation.
It's made much, much worse when I receive requests from people whom I perceive as being more established, and vastly more skilled in their chosen form of expression, and these people tell me they would like to do a piece of art in exchange for a piece of writing. Not only do I feel the familiar self-deprecation setting in, I also have a sense of... well, being humoured, if that makes any sense. As if I were a child pretending to an adult's dignities in the community. Let me make very clear that I do not for a second think that's what lies behind these requests, and if anyone has that thought, please understand that I wouldn't dream of suspecting any artist here of such a low motive. This is entirely a self-generated perception of the quality and worth of my writing which goes along with the self-deprecation.
For those who know, Taasla recently ran an auction to help out another member of FA, and after a serious amount of literal nail-biting, I worked up the courage to offer to write a story for the auction winner. This was one of those scaled auctions; as the bids got higher, more and more goodies got added to the pot. I consoled myself with the thought that the bid probably wouldn't get high enough that I would have to make good on my offer. Imagine my surprise when it did. I exchanged a series of notes with the auction winner, practically demanding a comprehensive biography of his character before I felt I could start writing the story - and I did the same to the beneficiary of the auction, since he had offered to pair one of his characters with the auction winner. Than Goddess both parties seemed to find the story enjoyable, but that was easily one of the most emotionally draining, nerve-wracking experiences I had ever gone through. While the ego-boo consequent to that story was most gratifying, I still felt the praise I received was far more lavish than the story warranted.
Now, I recently received a request for a commission. From someone whom I respect enormously, and who has a stable of characters that enthrall me, and with whom I enjoy exchanging banter and teasing in comments both on journals and submissions. But... I just can't bring myself to accept. Not yet. This may seem irrational, but to me, when money changes hands for something, that puts a much greater onus on the creator to make something truly worthy of the commissioner's coin, and I don't feel my work is yet of that calibre. The funny part - the funny-and-pathetic part - is that I have read the work of other writers here, and I can tell, intellectually, that my writing is probably on a par with quite a few of them. But there is, once again, that nagging self-doubt that colours my view of all my own work and downgrades it.
So... I've modified my profile to indicate that if someone would like to ask about a request or a trade, feel free to inquire. There are any number of other members on FA whose works I admire greatly and who would cause me to feel immensely flattered if they should think kindly enough of my skills to request a story or offer a trade. But I won't be taking commissions - not yet, maybe not ever.

ESSAY & RANT Copyright, Trademark, Public Domain Etc.
General | Posted 14 years agoOkay, having seen a few artists here get burned recently over issues of copyright and so on, I want to lay out a few simple guidelines. This is horribly over-simplified, but should make certain things clear.
Copyright is on a piece of work, literary, musical, artistic, etc. This is why Sony can copyright a disc of Beethoven's 5th; they haven't copyrighted the symphony, they've copyrighted the particular recording they're selling. So an artist can draw someone else's character and guess what? The artist holds the copyright on the drawing, not the other person. Most places, copyright automatically exists from the moment the work is created, though if you have to go to court over a copyright issue, registering the copyright will help you prove it. Copyright expires at different times depending on where you live, but as long as it's in force, the creator of that work has it.
Trademark is different; trademark protects symbols and logos used in commerce, hence 'trade'. Disney trademarks all its characters because it uses them as representations in business, including selling stuff with the characters on it. Also, trademark has to be defended if infringed; if a business does not defend (i.e., litigate) infringements on its trademark, a court may rule the company abandoned that trademark. That's why Disney goes after fanart of their characters so vigourously.
Pubic domain is stuff that used to be copyrighted and the copyright has expired, or the creator may decide to make it public domain right from the get-go. This doesn't mean someone else can come along and slap a copyright or trademark on it, though; once it's public domain, it stays public domain.
So, commissioners, when you commission a piece of art from an artist, unless you specifically arrange to purchase the copyright, it remains with the artist. Some artists offer 'private commissions', meaning they will not display that piece anywhere else, but they haven't given up the copyright. Some commissioners have gone so far as to remove the artist's signature/copyright and substitute their own, under the mistaken belief that since it's their character, it's their copyright, but that's clear and blatant copyright infringement, and in fact is grounds for court action.
Myself, I prefer to make sure I get clear statements from an artist regarding what I may and may not do with the art I get from them - can I post it on other sites, can I crop it to make icons, can I colour it, can I add a thing like "Rhiannon is the property of GingerM" to it. On the flip side, the stuff I've created and put up is very much copyright to me, no matter that it may have other characters in it, or even if it has none of my characters in it. I have a couple of things in mind for the future which I may make public domain, in which case I'll make it clear they are such. But if someone else comes along and tries to claim they can take ownership of them, they'll find out just how wrong they are.
ETA: Another common misconception is the idea that anything goes on the internet. Yes, copyright does exist on the internet, so ripping art and re-posting to uchan or e621 or whatever is copyright infringement. This is one of those situations, by the way, where strategically placed watermarks are the original artist's best friend if it becomes necessary to prove the origin of the work to these sites.

Myself, I prefer to make sure I get clear statements from an artist regarding what I may and may not do with the art I get from them - can I post it on other sites, can I crop it to make icons, can I colour it, can I add a thing like "Rhiannon is the property of GingerM" to it. On the flip side, the stuff I've created and put up is very much copyright to me, no matter that it may have other characters in it, or even if it has none of my characters in it. I have a couple of things in mind for the future which I may make public domain, in which case I'll make it clear they are such. But if someone else comes along and tries to claim they can take ownership of them, they'll find out just how wrong they are.
ETA: Another common misconception is the idea that anything goes on the internet. Yes, copyright does exist on the internet, so ripping art and re-posting to uchan or e621 or whatever is copyright infringement. This is one of those situations, by the way, where strategically placed watermarks are the original artist's best friend if it becomes necessary to prove the origin of the work to these sites.

The recipient, hereinafter "you", agrees that you understand, accept and will abide by the conditions set forth by the creator, hereinafter "I" or "me" as applicable. "Work" refers to the creation in whatever form or medium; commission" refers to the contract to create such work, whether as a gift, a request or a trade and does not necessarily imply payment.
1. Copyright & Posting
a) I retain copyright to the work; this copyright will NOT be transferred to you except at my sole discretion and for such recompense as is acceptable to me.
b) You have the right to re-post the work when, where and as you please, provided that you credit me as the creator of the work and link to my post of the work, or if not posted, to my user profile; and you credit all characters not your own to their owners.
c) No other party may re-post the work without my written permission; such permission will impose the same requirements as (a) and (b) except that such permission will be limited to one upload to one specific account on one specific site which will be identified if permission is granted.

I will NOT arrange this on your behalf, and if I do not receive that permission as described then I will not use their character.
e) I am willing to set stories in known fiction universes, however I will NOT, under any circumstances, use characters that are commercial properties; e.g., Oola (Star Wars), Neville Longbottom (Harry Potter), Mickey Mouse, etc. Please do not ask me; I will not do it.
3. Conduct
a) I will at all times be respectful and courteous in my communication with you, and I require you to do the same.
b) As this is a business transaction, do not engage in role-play while discussing the nature of the work to be done.
c) My real life is my business just as yours is yours. Do not ask for my real life information and do not give me yours.
4. Refusal and Termination
a) I retain the right to refuse a commission for any reason; I am NOT obliged to discuss or justify my reason for refusing.
b) I retain the right to terminate a commission after it has been started. In the event it was a trade, I will contact you to determine fair recompense if you've already completed your half of the trade. Note, however, that my preferred practice is to deliver my part of a trade first.
c) If you terminate the commission, I will be under no obligation to you of any kind.
5. Agreement
a) It is your responsibility to read and understand these terms. If you do not understand something, it is your responsibility to ask for clarification before accepting them.
b) These terms are not negotiable. Do not ask me to change them. Either accept them as they are or seek someone else.
