Kim's Terms of Service [2018 Revised]

By commissioning me, you are agreeing to all the clauses below:
I. General | Ordering Process
• Please write in a clear and easy to read format.
• All commissioners I require that you must use Email or a Discord tag so that I can be able to contact you easier.
• I require that all commissioners provide a clear reference sheet or either a clear full body image of your character, else I will treat it as a custom and charge more.
• You will be required to fill out a form for your commission, I will provide it to you via note or stash link. FORM LINK: COMMISSION ORDER FORM
• I, the artist, has every right to decline a commission if the user does any of the following:
>> Passive aggressive or manipulative behavior
>> Guilt tripping or begging
>> Harassment and usage of derogatory slurs
>> Attempting to haggle or swindle for a cheaper price
• Users not following my TOS are subject to blacklisting, I will not tolerate any form of toxic behavior. Period.
II. Turnaround Time | Payment
• Payment has to be upfront and in full. I will not do holds or payment plans for artwork costing $50 and lower.
• I only accept USD payments through PayPal only, do not offer me website or game currency as payment, as it will be declined.
• Payment plans are available for art costing $60-$90 or more, please send me a note to discuss a plan setup.
• Turnaround time for commissions can vary greatly, from several weeks to several months. In extreme cases, can be up to a full year. This can be affected by Mental/Physical health, family, and life issues.
• I have ADHD, which greatly affects how I focus and it can get really hard to get settled down to work. I ask that you, the commissioner, to please make sure you can ping or send me reminders as much as possible.
• I have 6 stages of the process to my work, those being:
>> The Draft Sketch Stage
>> Revision Sketches Stage
>> Final Sketch Stage
>> Lineart Stage
>> Base Color Layer Stage
>> Final Render
• These take time, and the time fluctuates greatly from commission to commission
III. Artist Limitations | Customer Satisfaction
• I the artist, can decline a commission if it contains anything that I am not comfortable drawing.
• Here is what I can draw and will accept for a commission:
>> Ferals | Animals
>> Dragons | Monsters
>> Anthros | Aliens
>> Suggestive | NSFW [Will not post to DA]
>> Some mild fetish content [Foot, and Mawshots are ok, not sure if fetish]
>> Nudity | Erections [will not post to DA]
>> Certain Closed/Open Species [See Here] List of Species I will/will not draw
• Here is what I will NOT draw and will decline such commissions
>> Bestiality | Animal abuse
>> Pedophilic acts | Minors in NSFW situations [Cub Shota, and Loli]
>> Abuse | Non-Con | Rape
>> Scat | Piss | Watersports | hardcore fetishes
>> Certain Closed/Open Species [See Here] List of Species I will/will not draw
• Minor edits to the artwork in its WIP stages are allowed, major edits may be given an added charge of $5 per major edit
• Edits will NOT be made after the lines and base coloring layers are made.
• I will always send WIP screenshots to the Commissioner upon request.
IV. NSFW Content
• To commission NSFW content from me, I STRESS GREATLY that you must be legally 18 years or older. I can not stress this enough. I am legally bound to follow the law to keep minors safe this is not a joke.
• Lying about your age can result in a blacklisting! I will not tolerate people breaking my TOS and possibly the law.
V. Copyright | Usage Permissions
• I the artist, hold the copyright to the artwork created, not the commissioner. They only hold copyright to the characters depicted.
• I can do the following with the artwork:
>> Publish and promote myself with it
>> Upload to all my social media accounts
>> Post it where I want
>> Use it as an example for future commissions
• What the Commissioner can do with the artwork:
>> Use for personal usage only
>> Upload to their galleries with credit
>> Print and display the art with credit, and claim rights to the character
>> Credit me on their reposts of the commission
• What the Commissioner can NOT do:
>> Use for commercial profit or make money off it in any shape or form
>> Alter the artwork or remove my signature
>> Claim rights to the artwork
>> Trace or use for their own art
• If you violate the usage policy, I have every right to file a DMCA takedown on all your known accounts as well as retract all rights to the artwork.
VI. Cancellation | Refund Policy
• I have every right to cancel a commission for any reason listed or unlisted. I do not have to inform the Commissioner of that reason whatsoever.
• Cancellation cannot be done once the commission is in the lineart stage
• I will always offer a full refund once if I have not started the commission, a 50% refund if in the final sketch stage, and a 25% refund if it is in the lineart/base color layer stage
• The Commissioner by no means whatsoever, is to file a charge back. Doing so results in retraction of all rights to any art made for them, and blacklisting/public warning of others to avoid that Commissioner.
VII. Blacklist | Refusal of Service
• I have every right to blacklist and refuse to serve any Commissioner for any given or ungiven reason. Begging me or guilt tripping me to remove someone from the list will not work and will result in a block.
• If I have a commissioner blacklisted, they can not:
>> Use artwork I have done for them, they lose all rights to that art
>> Commission me for any form of art
>> Have any form of contact to me
>> Have others commission for them
• These are the following users who are permanently blacklisted from ever getting art or designs from me:

VIII. Final Comments
• This TOS will change as I see fit, if it means adding or updating rules and policies
• This is a binding document, to all past and current commissioners, you are bound to follow and agree to these clause when you purchase from me
• Failure to comply will result in lost of artwork usage rights and blacklisting. No ifs ands or buts.
